The United States of America continues to welcome deserving immigrants, as they can significantly contribute to the country's population development, cultural diversity, and economic growth. Foreign nationals are permitted to enter the United States for various reasons, including family reunification, jobs, and capital investment.

Visas for immigration to the United States:

Usually, a foreign citizen can only apply for a US visa for immigration if he or she is supported by a US resident or citizen's immediate relative or a potential US employer. Before applying for the visa, they must also have an authorized petition.

Types of visas available for entry to the United States:

Immigration based on family ties: Immediate relatives and family choice is the two types of visas available for family-based immigration.

  • Immigrant Visas for Immediate Relatives These visa types are for more distant family members of a US citizen and persons with some specified relationships with a Lawful Permanent Resident (LPR). Categories under Family Preference visas are:
    • IR-1: citizen's spouse
    • IR-2: A US citizen's unmarried infant under the age of 21;
    • IR-3: A US citizen's orphan adopted abroad
    • IR-4: A US resident will adopt an orphan in the United States
    • IR-5: Parent of a US citizen under the age of 21.

    Immigrant Visas with a Family Preference: These visas are for members of a US citizen's extended family and people with such relationships with a Lawful Permanent Resident (LPR). Family Preference visas fall into the following categories: Unmarried sons and daughters of US residents, as well as their minor children, are given priority. Spouses, minor children, and unmarried sons and daughters of LPRs over the age of 21 receive Family Second Preference (F2). Married sons and daughters of US residents and their spouses and minor children receive Family Third Preference (F3). Family Fourth Preference (F4): United States citizens' brothers and sisters and their spouses and minor children. The sponsor must be over the age of 21.

  • Visa for Fiance The Fiance Visa: The K-1 visa is a non-immigrant visa requiring a foreign citizen's fiance to visit the United States and marry his or her sponsor within 90 days of arrival. After that, the visa holder may apply to have his or her status changed to permanent resident (LPR). An individual must meet specific requirements to obtain this visa.
  • Immigration for Work:   TThe United States issues about 140,000 employment-based immigrant visas to eligible applicants every year. Any of these visas enable applicants to bring their families with them to the United States. There are five types of employment-based immigrant visas:
    Immigration for Work Priority Worker (E1) is the first preference category. There are three sub-categories under this visa category:
    • Extraordinary Ability Individuals
    • Professors and Researchers of Note
    • Executives and Managers from Multinational Corporations

    Professionals with advanced degrees and people with exceptional ability are given second priority for employment (E2). The applicant must have a Department of Labor-approved labour credential. To apply for this visa, the applicant must have a job offer, and their US employer must file an Immigrant Petition for Alien Worker on your behalf.

  • There are two sub-categories in this category.
    • Professionals with a master's degree or a baccalaureate degree who have worked for at least five years.
    • People who excel in the sciences, the arts, or the business world. Qualified workers, professionals, and unskilled workers are the third employment preference (E3). The applicant must have an authorized Alien Worker Immigrant Petition filed by a US employer. They almost always necessitate Department of Labor-approved labour certification.
  • Fourth Preference for Jobs (E4): Special Immigrants An approved Petition for American, Widow/Widower, or Special Immigrant must be the recipient of a Fourth Preference applicant. They do not need a labour certification. 
  • Immigrant Investors (E5): Employment Fifth Preference Immigrant Investor visas are for international investors who choose to invest in new commercial ventures in the United States, resulting in new jobs.
  • Visa for Returning Residents:   To re-enter the country and become a permanent resident, a permanent resident (LPR) or conditional resident (CR) who has been outside the United States for more than one year or beyond the validity period of a Re-entry Permit will require a new immigrant visa.
